Cruise Terms and Conditions
The following terms and conditions (the “Cruise Terms and Conditions”) will only apply if you are booking or traveling on a travel program facilitated by Purple Star Travel, LLC which includes a cruise vessel component, charter vessel component or cruise ship component (each, a “Cruise”). The terms “we”, “us”, “our”, and “Purple Star Travel” refer to Purple Star Travel, LLC, a New York limited liability company. The term “you”, “customer”, or “the traveler” refers to the customer visiting or using the Purple Star Travel, LLC website and/or booking a reservation which includes, amongst other components of your travel program, a Cruise through our customer service agents. In addition to the terms and conditions displayed on this page, the terms and conditions displayed in the General Terms and Conditions shall also apply to your travel program, each as applicable. Except as expressly amended, modified and supplemented in these Cruise Terms and Conditions, the provisions of the General Terms and Conditions are and shall remain in full force and effect. With the exception of the specific terms and conditions of the Cruise Terms and Conditions displayed on this page, the General Terms and Conditions shall otherwise control.
- Registration and Payment
A minimum deposit of $450 USD deposit up to 30% of the total price of your entire travel program is required at the time of booking (the “Deposit”). We accept payment via credit card, certified check, wire transfer or money order for your Deposit.
With regards to the Cruise component of your travel program, the following payment terms shall apply, each as applicable based on the type of Cruise component in your travel program:
- With respect to river cruises and/or ocean cruises (collectively, “River Cruises and/or Ocean Cruises”), the balance owed for your entire travel program shall be 110 days prior to departure of the Cruise.
- With respect to expedition cruises (“Expedition Cruises”), the balance owed for your entire travel program shall be due 150 days prior to departure of the Cruise.
- Cancellation
All cancellations of confirmed reservations are subject to a $450 per person administrative fee. Additionally, clients are subject to any cancellation fees assessed by the purveyors of services including hotels, rail, connecting cruise lines, connecting chartered vessels or airlines used in the itinerary to facilitate any Cruise. The following cancellation fees shall apply, each as applicable based on the type of Cruise in your travel program:
- With respect to Expedition Cruises, cancellations which occur 150 days or more prior to departure will receive a refund of your travel program minus the Deposit. Cancellations which occur less than 150 days prior to departure will be subject to the loss of the full cost of your travel program.
- With respect to River Cruises and/or Ocean Cruises, cancellations which occur 110 days or more prior to departure will receive a refund of your travel program minus the $350 per person administrative fee and the Deposit. Cancellations which occur 60 – 109 days prior to departure will be subject to loss of an amount equal to 35% of the total cost of your travel program. Cancellations which occur 59- 31 days prior to departure will be subject to loss of an amount equal to 50% of the total cost your travel program. Cancellations which occur 30days or less prior to departure will be subject to loss of an amount equal to 100% of the total cost your travel program
In addition to the terms and conditions described in this Section 2 of the Cruise Terms and Conditions displayed on this page, you acknowledge that the Cruise in your particular travel program may have exceptions to the cancellation terms described in this Section 2 of the Cruise Terms and Conditions displayed on this page. For the avoidance of doubt, the cancellation terms which are applicable to your Cruise shall be described in the quote associated with the booking of your travel program. It is your responsibility to familiarize yourself with the cancellation terms which are applicable to your Cruise in particular.
- Cruise Service Providers The Cruise used in your travel program may utilize onboard service providers, which may include medical staff, spa personnel, or entertainers who operate as independent contractors (each, an “Independent Cruise Contractor”). All Independent Cruise Contractor(s) providing services and/or products to you are charged as optional extra services and such services and products are contracted between such Independent Cruise Contractor(s) and you pursuant to any products and services you request from such Independent Cruise Contractor(s). Purple Star Travel, LLC is not responsible for these optional extra services and will not be liable for the acts or omissions of such Independent Cruise Contractor(s).
In addition to any services provided by any Independent Cruise Contractor, the Cruise used in your travel program may offer to you shore excursions or any other land travel products which are either owned or operated by the Cruise. You acknowledge and agree that Purple Star Travel, LLC is not responsible for any such shore excursions and/or land travel products and that the Cruise shall be responsible for the operation of any such shore excursions and/or land travel products.
Any products or services offered by the Cruise, which may include a gift shop and/or a bar, are optional and you acknowledge and agree that availing yourself of any such services shall incur a separate additional fee charged by the Cruise to you.
- Limits on Responsibility & Force Majeure In addition to Section 11 of the General Terms and Conditions, any Cruises, including vessel charters, may involve many additional factors outside of Purple Star Travel, LLC’s control which can disrupt your travel program, including but not limited to all issues related to mechanical issues, unavailability of guides or crew, outbreaks of illness on prior departures that affect the availability of crew and guides on the client’s departure, weather, re-routing of itineraries due to mechanical issues, water levels, or the illness of any passengers or crew or for any other reason, and many other factors. Purple Star Travel, LLC has no control over the operation of the cruise ship or charter vessel being booked and is acting as a booking agent with regard to all Cruises. Purple Star Travel, LLC cannot be held liable for anything related to the operation of, or failure to complete, any Cruise itinerary or for any actions or inactions of any Cruise operators, each of which are totally separate entities from Purple Star Travel, LLC. Flight issues and delays can also result in missing Cruises or other services which may form part of your travel program, and Purple Star Travel, LLC has no control over such situations and cannot be held responsible for them.
- Passenger Bill of Rights and/or Cruise Line Rule & Regulation
In addition to these Cruise Terms and Conditions displayed on this page, you acknowledge and agree that you are also subject to any third-party additional rules, regulations, passenger bill of rights, cruise vessel policies and other third-party terms and conditions which are applicable to each Cruise (each, a “Cruise Line Rule & Regulation”). You acknowledge and agree that Purple Star Travel, LLC is not responsible for the contents of any Cruise Line Rule & Regulation and you further acknowledge and agree that Purple Star Travel, LLC is not under any obligation whatsoever to provide you with any Cruise Line Rule & Regulation which may be applicable to your travel program. It is your sole responsibility to (i) avail yourself of any Cruise Line Rule & Regulation which may be applicable to your travel program and/or your Cruise and (ii) comply with any Cruise Line Rule & Regulation. Any such Cruise Line Rule & Regulation(s) may impact your travel program and Purple Star Travel, LLC shall not be responsible for any direct or indirect impact upon your travel program which relates to any Cruise Line Rule & Regulation.
