Terms and Conditions – Villas

The following terms and conditions (the “Villa Terms and Conditions”) will only apply if you are booking or traveling on a travel program facilitated by Purple Star Travel, LLC which includes a villa component (a “Villa”). The terms “we”, “us”, “our”, and “Purple Star Travel” refer to Purple Star Travel, LLC., a New York limited liability company. The term “you”, “customer”, or “the traveler” refers to the customer visiting or using the Purple Star Travel, LLC website and/or booking a reservation which includes, amongst other components of your travel program, a Villa through our customer service agents. In addition to the terms and conditions displayed on this page, the terms and conditions displayed in the General Terms and Conditions shall also apply to your travel program, each as applicable. Except as expressly amended, modified and supplemented in these Cruise Terms and Conditions, the provisions of the General Terms and Conditions are and shall remain in full force and effect. With the exception of the specific terms and conditions of the Villa Terms and Conditions displayed on this page, the General Terms and Conditions shall otherwise control.

Registration and Payment A deposit equal to 50% of the total price of your entire travel program is required at the time of booking is required at the time of booking (the “Deposit”). We accept payment via credit card, certified check, wire transfer or money order for your deposit. The balance is due 90 days prior to departure. If your reservation is made within 90 days of departure, the entire cost of the trip must be paid at the time of confirmation.

As part of the price of the Deposit, a security deposit for the Villa shall be due in an amount described in the quote provided to you in connection with your booking of the Villa (the “Security Deposit”). The Security Deposit varies based on the Villa and you acknowledge that the exact amount of the Security Deposit shall be disclosed to you by Purple Star Travel, LLC upon quoting and invoicing in connection with the booking of your Villa. Provided that you, and any guests approved by Purple Star Travel, LLC to occupy the Villa, have complied with the requirements described in Section 4 of these Villa Agreement Terms and Conditions, your Security Deposit will be reimbursed to you following your departure from the Villa. If, on the day of your arrival, you discover there are any pre-existing damages to the Villa, damaged items within the Villa, or cleaning concerns associated with the Villa, you acknowledge and agree to notify Purple Star Travel, LLC of such damage on the day you arrive at the Villa. In the absence of such notice, all damages and losses during the occupancy shall be deemed to be the guest’s responsibility. The client acknowledges and agrees to be fully responsible to pay for any repairs or replacements of broken or lost items and/or damage to the Villa.

Cancellation All confirmed reservations are non-refundable. In the event of cancellation of your Villa, any potential refunds for your Villa remain solely subject to the sole discretion of Purple Star Travel, LLC.

Security Deposits Upon the end of your stay at the Villa and if no damage has been caused to the Villa, the Security Deposit will be refunded to you after your departure from the Villa. Please review the Villa Accommodation Rules (as defined below in Section 4 of these Villa Terms and Conditions) for further information on the rules that shall apply to your stay at the Villa and whether you shall receive your Security Deposit upon the conclusion of your stay at the Villa.

Villa Accommodation Rules Each of the following paragraphs in this Section 4 of these Villa Agreement Terms and Conditions (each, the “Villa Accommodation Rules”) shall apply to your stay in a Villa:

a) You acknowledge and agree that the Villa is not owned by Purple Star Travel, LLC and that each Villa is owned and/or operated by a third-party (each, a “Villa Owner”);

b) Leasing of the Villa is for the sole purpose of residential housing for you, and any guests approved by Purple Star Travel, LLC, for the specific period of time described in your travel program and the Villa shall not be used for any other purpose. The total number of guests at the Villa cannot exceed the number identified in your travel program itinerary. You acknowledge and agree that parties, weddings, receptions, or other such group functions which attract additional neighbourhood traffic are prohibited unless you obtain the prior written permission from Purple Star Travel, LLC. Further, you acknowledge and agree that any of the foregoing uses of the Villa may require additional requirements and fees as deemed necessary by Purple Star Travel, LLC;

c) Decorative items in the Villa may differ from the photos shown on the Website (as such term is defined in the General Terms and Conditions);

d) Pets are not allowed unless stated otherwise in the booking confirmation or reservation voucher. The use of firecrackers and fireworks is strictly prohibited;

e) With the sole exception of Supporting Personnel (as defined below), you are not permitted to hire or contract with outside service providers without the prior written permission of Purple Star Travel, LLC. Failure to obtain such written permission may result in Purple Star Travel, LLC denying such outside service providers entrance into the Villa. In the event that outside providers are found working inside the Villa without such permission of Purple Star Travel, LLC. Purple Star Travel, LLC reserves the right to cancel such services immediately and Purple Star Travel, LLC shall not be responsible for any monetary losses or damages pursuant to such service providers;

f) The Villa has a non-smoking policy indoors and all guests must strictly follow it. If you, or any guests approved by Purple Star Travel, LLC, choose to smoke outside, you are required to use the ashtrays provided outside of the Villa;

g) The Villa Owner reserves the right to enter the property for inspection at all times provided that reasonable warning/notice has been provided to you in advance. You acknowledge and agree that supporting personnel, including but not limited to, chefs, maids, gardeners, pool/Jacuzzi maintenance people (collectively, “Supporting Personnel”) will enter the property at pre-agreed times. Purple Star Travel, LLC shall inform you of the dates and times where Supporting Personnel will enter the Villa;

h) Upon the end of your occupancy at the Villa, you are expected to ensure the Villa is in a clean and tidy condition. An extra cleaning fee may be subtracted from the Security Deposit if the Villa is left excessively dirty or left in a condition, in the sole determination of Purple Star Travel, LLC, which requires additional cleaning beyond the ordinary course of use;

i) Changing the setting or decoration of the Villa, including furniture placement, without the prior consent of the Villa Owner is not allowed. Inside furnishings must remain inside the Villa and outside furnishing must remain outside the Villa. Rearranging the property situated on the Villa may lead to (i) a cancellation of your Villa booking, (ii) forfeiture of the cost of your entire stay at the Villa and (iii) forfeiture of your Security Deposit;

j) You are liable for any damage to the Villa or for the removal/destruction of any items on and around the Villa, including but not limited to, plants, external structures, etc. You are expected to respect the Villa and the contents of the Villa. Villa items, including but not limited to, linen and/ ornamental items must remain at the Villa;

k) You, and any guests approved by Purple Star Travel, LLC, must not jeopardize the integrity of the Villa or any buildings and/or structures which surround the Villa. You acknowledge and agree not to expose either of the foregoing to fire, explosives, flammable or pressurized liquids (e.g. scuba tanks, oxygen bottles, liquefied gas bottles, etc.). In the event of such damage to either the Villa or any surrounding buildings and/or structures, you shall be held liable for any damages and/or charges, whether such damages are direct, indirect or consequential, shall be levied according to the applicable law(s) of the jurisdiction in which the Villa is located;

l) Neither Purple Star Travel, LLC nor the Villa Owner assumes any responsibility for any accidents, injury, death or other losses in connection with your occupancy (or the occupancy of any guests approved by Purple Star Travel, LLC) of the Villa, including consequential damages from the rental and use of the Villa or any other properties of the Villa Owner. By paying your booking deposit, you acknowledge and agree that (i) you have accepted these Villa Terms and Conditions and (ii) you have fully waived your right to any future claim against the Villa Owner and/or Purple Star Travel, LLC in case any accidents, injury, death or other losses in connection with your occupancy (or the occupancy of any guests approved by Purple Star Travel, LLC) of the Villa;

m) In the event the Villa includes a swimming pool or jacuzzi, you assume full responsibility for the use in or around swimming pools. In case of accident, injury or death, you, and any guests approved by Purple Star Travel, LLC, waive any future claim against the Villa Owner and/or Purple Star Travel, LLC;

n) You are fully responsible for any property and/or valuables which are situated at the Villa. You acknowledge and agree that neither Purple Star Travel, LLC nor the Villa Owner shall be responsible for any theft or damage to any of your property or valuables and you further agree that Purple Star Travel, LLC shall not be responsible for the act or omission of any Supporting Personnel;

o) A maximum of two persons shall be allowed per bedroom within the Villa unless you have submitted a written specific request which has been approved by the Villa Owner. In the event you exceed this limit, an extra fee will be requested, or guests will have to vacate the Villa, without any refund to you, as determined by the Villa Owner’s sole discretion;

p) You acknowledge and agree that you shall personally occupy the Villa and you shall not, nor shall any of the guests approved by Purple Star Travel, LLC, sublet any portion of the Villa;

q) You acknowledge and agree that is your responsibility to familiarize yourself with any applicable by-laws and/or local rules or regulations which pertain to noise or any other disturbances in connection with your occupancy of the Villa;

r) Unless written permission has been provided by either Purple Star Travel, LLC or the Villa Owner, you acknowledge and agree that animals are forbidden in or around the Villa; and

s) Neither Purple Star Travel, LLC nor the Villa Owner shall be responsible for any roadwork or construction near the Villa.
